In accordance with the Resolution of the Cabinet of Ministers No. 172 on March 19, 1994 on the implementation of certain provisions of the Law of Ukraine "On Protection of Consumer Rights", according to which high-quality food products are not subject to exchange and return.
1. General Provisions
1.1. This offer is an official proposal of the website streetsoup.com.ua, FOP "Levytska O.V.", hereinafter referred to as the "Seller", to conclude a remote purchase and sale agreement for goods, i.e. through the Internet store, hereinafter referred to as the "Agreement", and places a Public Offer (Proposal) on the official website of the Seller "https://streetsoup.com.ua" (hereinafter - the "Website").
1.2. The moment of the full and unconditional acceptance by the Buyer of the Seller's proposal (acceptance) to conclude an electronic purchase and sale agreement for goods is considered to be the fact of the Buyer's payment of the order on the terms of this Agreement, within the terms and prices specified on the Seller's website.
2. Terms and Definitions
2.1. In this offer, unless the context requires otherwise, the following terms have the following meanings:

* "Online store" - according to the Law of Ukraine "On electronic commerce", a means of submitting or selling goods, works or services by concluding an electronic agreement.

3. Subject of the Agreement
3.1. The Seller undertakes, on the terms and in the manner determined by this Agreement, to sell the Goods based on the Order placed by the Buyer on the corresponding page of the Website https://streetsoup.com.ua/, and the Buyer undertakes, on the terms and in the manner determined by this Agreement, to purchase the Goods and pay for it.
This Agreement regulates the purchase and sale of goods in the Online store, including:
- the voluntary choice of the Buyer of goods in the Online store;
- independent drafting by the Buyer of the Order for the selected Goods in the Online store;
- payment by the Buyer of the Order placed in the Online store.
4. Order of purchase and payment for Goods
4.1. The Buyer has the right to place an order for any product presented on the website of the online store and which is in stock.
4.2. In the absence of the product in stock, the company's Manager is obliged to inform the Buyer (by phone or by email).
4.3. In the absence of the product, the Buyer has the right to replace it with a similar product, refuse the product, or cancel the order.

7.2 The Buyer is obliged:
- To pay and receive the order in accordance with the terms of this agreement.
7.3 The Buyer has the right:

- To demand from the Seller the fulfillment of the terms of this agreement.
8. Liability of the parties
8.1 The Parties are liable for non-performance or improper performance of the terms of this agreement in the manner provided for by this agreement and the current legislation of Ukraine.
8.2 The Seller is not liable for:
- for the content and truthfulness of the information provided by the Buyer when placing an order;
- for delays and interruptions in the provision of Services (order processing and delivery of goods) that occur due to reasons beyond its control;
- for unlawful illegal actions committed by the Buyer using this Internet access;
8.3. In the event of force majeure circumstances, the parties are released from the performance of the terms of this agreement. For the purposes of this agreement, force majeure circumstances mean events that have an extraordinary, unforeseeable character, which exclude or objectively hinder the performance of this agreement, the occurrence of which the parties could not have foreseen and prevented by reasonable means.
8.5. The parties make every effort to resolve any disputes exclusively through negotiations.
9. Other conditions
9.1. The online store reserves the right to unilaterally make changes to this agreement, provided that it is published in advance on the website https://streetsoup.com.ua/
9.2. The online store is created to organize distance sales of goods over the Internet.
9.3. The Buyer is responsible for the accuracy of the information provided when placing an order. At the same time, when accepting (placing an order and further payment of the goods), the Buyer gives the Seller its unconditional consent to the collection, processing, storage, and use of its personal data, within the meaning of the Law of Ukraine "On Protection of Personal Data".
9.4. Payment by the Buyer of the order placed in the online store means full agreement of the Buyer with the terms of the purchase and sale agreement (public offer).
9.5. The actual date of the electronic agreement between the parties is the date of acceptance of the terms, in accordance with Article 11 of the Law of Ukraine "On Electronic Commerce".

10. Duration of the Agreement
10.1. The electronic agreement is considered concluded from the moment of receipt by the person who sent the proposal to conclude such an agreement, of the response regarding acceptance of this proposal in the manner determined by part six of article 11 of the Law of Ukraine "On E-Commerce".
10.2. This Agreement may be terminated by mutual agreement of the parties until the actual delivery of the goods, by refunding the money.
10.3. The parties have the right to unilaterally terminate this Agreement in case of non-fulfillment of the conditions of this Agreement by one of the parties and in cases provided for by the current legislation of Ukraine.
